Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of the RecruitingBuddy.ai platform ("Platform"), operated by Recruiting Buddy ("we," "us," or "our"). By creating an account or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.
Use of the Platform
Eligibility
You must be at least 18 years old and authorized to act on behalf of the organization you represent. The Platform is intended for use by staffing companies, recruiters, and HR professionals for lawful employment screening purposes.
Permitted Use
You may use the Platform to screen job candidates, manage recruitment campaigns, place automated screening calls, and communicate with candidates who have applied for or expressed interest in employment opportunities.
Prohibited Use
You agree not to:
- Use the Platform for any unlawful purpose or in violation of applicable employment, privacy, or telemarketing laws
- Upload or process candidate information without a lawful basis for doing so
- Attempt to reverse-engineer, hack, or disrupt the Platform or its infrastructure
- Use the Platform to contact individuals who have not consented to be contacted for recruitment purposes
- Resell, sublicense, or otherwise transfer access to the Platform without our written consent
SMS Messaging Terms
Message and data rates may apply. Message frequency varies based on recruitment activity and campaign settings. Reply STOP to unsubscribe. Reply HELP for help. Mobile opt-in data and SMS consent are not shared with third parties or affiliates for marketing or promotional purposes.
Nature of Messages
The Platform sends automated recruiting-related SMS messages to candidates on behalf of staffing companies. These messages include AI screening call notifications, application follow-ups, interview scheduling, interview reminders, job availability updates, and candidate support communications. All messages are directly related to an active recruiting or employment process.
Candidate Consent Requirements
Candidates must provide their phone number and affirmatively consent to receive recruiting-related SMS messages before any message is sent through the Platform. Consent is collected at the point of phone number submission during a job application, ATS registration, recruiter intake form, job board application workflow, or candidate onboarding process operated by the staffing company.
Staffing companies using the Platform are required to include the following or equivalent consent language at the point of phone number collection:
"By providing your mobile number, you agree to receive recurring recruiting-related text messages from [Staffing Company] and/or Recruiting Buddy on behalf of [Staffing Company]. Message frequency varies. Message and data rates may apply. Reply HELP for help. Reply STOP to opt out. Consent is not a condition of purchase."
Message Frequency
Message frequency varies. Candidates may receive one or more messages per job application or screening campaign depending on the stage of the hiring process. Recruiters control the volume and timing of outreach sent through their account.
Message and Data Rates
Standard message and data rates may apply depending on the candidate's mobile carrier and plan. Recruiting Buddy is not responsible for any charges a carrier may impose for receiving SMS messages.
Opt-Out — STOP
Candidates may opt out of SMS communications at any time by replying STOP to any message. After opting out, a final confirmation message will be sent and no further messages will be sent to that number for the relevant campaign. To re-subscribe, reply START. Opt-out requests are honored promptly and no additional recruiting messages will be sent after a STOP is processed.
Help — HELP
For assistance, reply HELP to any message or contact us at support@recruitingbuddy.ai. A HELP reply will return contact information and instructions.
No Sharing of SMS Consent Data
Mobile opt-in data, phone numbers, and SMS consent information are used solely for the recruiting-related communications described in these Terms and our Privacy Policy. This data is not sold, rented, or shared with unaffiliated third parties for advertising, marketing, or promotional purposes. See our SMS Program page for full disclosures.
Recruiter Responsibilities
Staffing companies and recruiters using the Platform are responsible for ensuring they have obtained appropriate consent from candidates prior to initiating SMS communications, in compliance with the Telephone Consumer Protection Act (TCPA), applicable FCC regulations, and any state laws governing automated or commercial text messaging.
Automated Calling
The Platform places automated outbound voice calls to candidates using an AI powered screening system. By using this feature, you represent and warrant that:
- Candidates have consented to receive automated calls in connection with their job application
- You have a legitimate recruitment purpose for each call placed
- You will comply with the TCPA, the FCC's regulations, and any applicable state laws governing automated calls
Call recordings may be stored and made available to the recruiter through the dashboard. Candidates are informed at the start of each call that they are speaking with an automated AI system.
Accounts and Security
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account. We are not liable for losses resulting from unauthorized account access due to your failure to secure your credentials.
Organization accounts include role based access controls. Account managers are responsible for managing recruiter access within their organization.
Intellectual Property
The Platform, including its design, features, and underlying technology, is owned by Recruiting Buddy and protected by intellectual property laws. You are granted a limited, non exclusive, non transferable license to use the Platform for its intended purpose during the term of your subscription.
Candidate data you upload remains your property. You grant us a limited license to process that data solely to provide the services described in these Terms.
Disclaimers and Limitation of Liability
The Platform is provided "as is" without warranties of any kind, express or implied. We do not warrant that the Platform will be uninterrupted, error free, or that AI generated screening results will be accurate or suitable for your hiring decisions.
To the maximum extent permitted by law, Recruiting Buddy shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, including any hiring decisions made based on AI screening results.
Termination
We reserve the right to suspend or terminate your account if you violate these Terms or use the Platform in a way that could harm candidates, third parties, or the integrity of the service. You may cancel your account at any time by contacting support.
Governing Law
These Terms are governed by the laws of the State of Indiana, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Marion County, Indiana.
Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or through the Platform. Continued use after changes take effect constitutes your acceptance of the revised Terms.
